The“One Belt and One Road”(B&R) Initiative is in compliance with the irresistible trend of globalization and was resulted there from. As international public goods, it has, since unveiling by China in 2013, attracted much attention in the international community. The B&R covers countries across Asia, Europe and Africa which have diversified cultures, tradition, and legal and political systems. Most of these countries practice market economic system. At the same time, B&R involves extensive government to government, enterprise to government and enterprise to enterprise co-operations. With these features, the implementation of the B&R requires a legal framework commensurate with the needs of the B&R countries. This report will focus on the legal framework, which not only including both procedural and substantive rules, but also incorporate the existing basic international law principles and take into account the experiences and lessons of the existing multilateral systems. At the same time, it must promote free trade and investment and multilateralism. Thus the B&R legal framework and the existing international order will mutually supplement and support one another, and make its contributions to advancing international law in particular international trade and investment law.
Professor Guiguo Wang is the member of the national committee of CPPCC，and also the member of International Commercial Expert Committee of the Supreme People's Court. He has undertaken the Major Program of the National Social Science Foundation of China. Professor WANG is the President of the Academy of International Strategy and Law, University Professor and National 1000 Plan Professor of Zhejiang University, Hangzhou, China, Vice President of the Chinese Society of International Economic Law, President of International Academy of the Belt and Road, Hong Kong, China, and Eason-Weinmann Chair of International and Comparative Law, School of Law, Tulane University, New Orleans, USA. Professor WANG is also the former Dean of School of Law, City University of Hong Kong, an arbitrator of China International Economic and Trade Arbitration Commission, Beijing Arbitration Commission, Hong Kong International Arbitration Centre, and Panel of Arbitrators of Korean Commercial Arbitration Board, Korea.
Professor WANG, holder of the JSD degree from Yale Law School and LL.M. degree from Columbia Law School, is the first Chinese recipient of the United Nations Legal Affairs Office and the United Nations Institute for Training and Research fellowship which enabled him to participate in the seminars offered by the International Court of Justice and to study at The Hague Academy of International Law, the United Nations and the World Bank. Professor Wang has published more than 20 books and more than 100 journal articles in the well-known journals in China and other countries. Professor Wang’s main works include: International Economic Law (1992); International Trade Law (2004); International Monetary and Financial Law (3nd Ed., 2007); International Investment Law (2nd Ed., 2008); International Law Perspective of the Belt and Road Initiative (Co-ed.) (2016); Dispute Resolution Mechanism for the Belt and Road (Co-ed.) (2016); Essential of the Laws of the Belt and Road Countries (Co-ed) (2017). His proposal on the establishment of a "One Belt And One Road" dispute settlement organization has received positive approval from many central leaders, including President Xi Jinping and Prime minister Li Keqiang.
